My question involves criminal law for the state of: Michigan
I am 20 years of age and have been charged with possession of marijuana. My record is completely clean. I complied with the police fully. They pulled me over when I was coming out of a alley way in a nearby field and asked me what I was doing there and I said I was talking on the phone and then they asked if I had been smoking marijuana (I assumed they could smell it) and I said yes I have been. They took me out of the car and proceeded to ask a couple of basic questions on why I was smoking and I told them I have frequent headaches. They asked to search the car because they knew I had the substance on me and I let them search the car thinking nothing of it. Long story short they charged me with possession of marijuana instead of a DUID. I was very fortunate they did this cause they could have easily booked me for a DUID.
I guess I just want to know whether or not I should get a lawyer or just have one appointed to me by the court. I also want to know if I should plead guilty or not guilty and see if I can use the 4711 diversion. I just need some advice on what I should do because I really do not want to pay for a lawyer and I want to keep this a secret from everyone I am associated with because this is utterly embarrassing. Some advice would be greatly appreciated on what the process will be like when I get in the court room and what kind of sentence I will get.
