    Default Dealership Misrepresented Age of Vehicle

    I recently traded in my Bronco on a motorcyle. My purpose was that the truck had some problems and got horrible gas milage. That insurance on the bike is only $200 a year for full coverage which is $2000 less than the truck's and the gas milage is great, which is helping me pay my other bills. My problem is that I was told that the bike was a 2003 by the dealership. I even signed papers stating that, but yesterday my insurance company called me and told me that the bike is really an '01 according to the VIN. I called the dealership who told me that they would adjust it in there records and let the leinholder know as well. I think that the man who owns the dealership works for the leinholder. I told them that I would have never bought a 2001 for $7000 when they sell for $2900 right down the street. They said that there was nothing that they could do and the bike would be repoed if I did not give them the other half of the $1500 down payment that I owe them on Friday. Is this legal? If not, what are my options?

    This is in Florida? I'm answering generally, not specifically under any one state's laws.

    You may be able to have the contract of sale set aside (by a court) on the basis of "mutual mistake", although it's hard for me to believe this was a mistake by the dealer. You also may wish to sue them for the difference in value between the bike they told you they were selling to you and the bike they acutally sold to you. You should consider consulting area lawyers who handle consumer law matters, to see if you have additional remedies.

    According to the Florida State Bar, you can sue in Florida Small Claims Court for up to $5,000.00.

    aaron, thanks for the quick response.

    I do live in Florida.

    I talked to them again asking to lower the price but they said that they had too much money into the bike. According to them they gave the prior owner more than it was worth, thinking that is was an 03. It was not untill they got the title that they noticed it was an 01 and had no intention of letting me know. Now they want me to bring $750 to some guy over an hour across town or they are going repo the bike today and sue me for mileage on the bike plus wear and tear. According to the salesman there, that has left the employment of the company this morning, this is a common practice at this particular dealership. They also, according to him, kept a key to the bike so they could just swing by and ride off on it.
