    Default Lease Agreement Signed with Previous Management, Breaking Lease Consequences

    My question involves landlord-tenant law in the State of: Texas

    I have a signed lease with management A from August 2011 to July 2012. Current management, B has taken over and their new lease agreement states that if 60 day notice is not given to break the lease I will have to pay 100% of rent from May to July, even though I am moving out May 15.

    My previous signed lease agreement stated that if I broke the lease I would have to pay $386.75, but I would not have to pay the rest of the rent for the upcoming months that I will not be living here.

    I haven't signed anything from management B stating that I agree and understand the new terms of service.

    A meth lab was busted two doors down from me within the last month, the new management did not replace sheet rock, clean the walls, fumigate, or anything of the sort. They mopped the floors and then opened it up for new tenants.
    -Is this legal?

    I have had police officers come up to my door telling me how unsafe this area is and that I need to move out.
    The apartment complex claims that 24/7 there are at least 2 officers from the are that patrol the (ungated) complex, however when I approached one officer, they claimed that they all refused to live here because of how unsafe it is and that they only come patrol on Friday and Saturday nights.

    I have notes from my doctor saying because of this apartment my health is going downhill because of the stress that this apartment complex gives me.

    I have been broken into once, last week I had another (attempted) break in at 6 pm (daylight) and I was home while someone tried to break the handle off of my front door.

    I want to fight this, I have the funds to pay for my new apartment building (that has awards for its safe neighborhood and security) but I will not be able to affort it if I also have to pay the remaining 4 months of $400+/month rent.


    Can someone please tell me if this is legal considering I haven't signed a new lease agreement, I haven't spoken to new management about the changes. I also gave an official notice on April 14th to management B (new management) and today they called threatening to evict me because I did not warn them about moving out on May 15. When I physically handed them my notice on April 14th, they did not tell me I had to give 60 days, they told me that was adequate and that I would have to pay a fee, but not the rest of the four months rent.


    Can I fight this? Please help!

    If your lease is still in effect and says that you can move upon paying a fee of $386.75, a change of management won't affect that provision.
