In California.
We were separated about 5 years ago. We are still working through the divorce paperwork (doing it myself). We have gone down the default path in order to save us some money. Over the last 5 years I have been paying "temporary" spousal support which includes cash and paying all the bills for her. Because we were married for 15 years and lived together 5 years prior to marrage, we agreed to support payments for 11 years (half the number of years we were together plus a year). During our marrage she did not work much in order to raise our children (which are both adults now). The temporary agreement has me paying her about half of my "discretionary income". After 5 years of separation she is still not working.
My questions are:
1. After the default and final judgement can she get the courts to extend the term and/or modify the amount? is there a way to make it so she can not?
2. Should the judgement state that paying the bills for her are "in-lue"of support or in addition to support?
3. What are generally the rules for support in a 15 year marrage?
