    Default Waiver of Liability to Drive Someone Around

    My question involves an injury that occurred in the state of: Florida

    Info please. Before I answer an ad to drive a local person around for hourly pay & gas, I would like to know if a signed waiver from them in the event of an accident, will hold up legally? Or am I on my own (I'm insured of course) ??

    waivers are often defeatable, especially if you are negligent in some way. Insurance is your only insurance.

    If you want to be a chauffeur, make sure you have a chauffeur's license and that you're insured as a commercial driver. If you are not acting in a lawful manner, you cannot count on a court to enforce a waiver of your liability to your client.

    If your vehicle isn't insured for you to transport paying passengers, then when the time comes for you to need your insurance, the insurance company will walk away from you when you need a claim covered.

    If your properly insured for paying passengers, then what are you worried about?

    Waivers can't disclaim gross negligence nor can a person waive someone else's right to sue, so if you kill your passenger you can still be hit with (and lose) a wrongful death suit.
