My question involves landlord-tenant law in the State of: California
In the course of trying to find my property manager's street address and running into brick walls, I tried looking up their info with the Calif DRE. There is only a similar named co whose lic expired in the 90s. I called DRE to see if their reps had better data and she found another similar name registered to a broker but it was not the exact name. Say all my paperwork is with "XYZ Management" and the official name she found is XYZ Property Management. There's no fictitious business for XYZ Management.
She said that's a violation and suggested I talk to enforcement and that his suggestion I filed a complaint about their negligence in maintaining my apt and how they present their company name. Either they're doing activities of a broker without a license or they have a license and are not representing themselves correctly, both of which are violations. If there is ever a need for me to sue them and serve papers, I have no way to identify or locate them.
Curious about my rental agreement, I observed it is with myself and (my street address) + XYZ. No other words or letters. So that is *really* not a legit entity. I make my checks out to a person who is one of three individuals who own every condo in this building, but I have no other dealings with him directly. My street address does come up as an LLC but I have no idea how it fits in the picture. Unless things changed since I looked it up in the county records, the LLC is not an owner and they can't be the property managers according to DRE (no LLCs).
Is my rental agreement enforceable if it's not with any legally registered company, exactly? I know I wouldn't be able to put my first name only and it seems they are trying to get away with something by using an inexact name.
Assuming it's not enforceable, how does it affect their ability to do things like raise my rent, enforce their petty rules, charge late fees, etc? Not that I have ever caused problems but I need to know where things stand. If they come around and say I must sign a new agreement, and I don't, they CANNOT evict me because in my city once you're a tenant for 2 years they can only evict for non-payment of rent and I guess if you become a huge nuisance but I'm very quiet and considerate and always pay my rent. The only thing I do that bugs them is insist that they fix leaky roofs, light dark stairwells, etc. If the roof doesn't get fixed though, I may have to go to a motel and since they believe they have no liability even for their own admitted negligence, I may have to sue. I also understand that I am probably also entitled to back rent on days it was uninhabitable, and basic weatherproofing is a habitability issue, not to mention their documents say this building probably has asbestos in the walls and ceiling. My rental agreement forbids me to fix the ceiling myself for that reason. But ... do I even have a valid rental agreement?
Please don't suggest I move. I'm not interesting in moving and I like my apartment when it's not raining inside.
