My question involves landlord-tenant law in the State of: Florida
My lease of a home ended March 31st. We agreed along with the homeowner to renew the lease for 12 months with an option to opt out of the lease after 6 months. The HOA rules state that leases must be approved by them and are required to be 12 months but they will not approve our renewal because there is an opt out clause. The rules state that the home owner may not have more than two rental agreements in a calendar year but they are telling the homeowner that he is not permitted to lease to us with an opt out clause because they will not permit him to do another lease before the end of my current lease renewal. The HOA rules say that he has to evict us if we don't comply with the demand for a 12 month lease without the opt out clause OR they will begin eviction proceedings on his behalf. We currently don't have a signed lease and our payment for this month has been accepted. Can the HOA legally evict us? We've never been late with rent and owe no fees.
