My question involves an eviction in the state of: Florida
10 years ago I bought a mobile home, paid it off within 16 months and have lived here for 10 years . I have never been late on my lot rent until recently, last year i was diagnosed with cancer, no biggie for me i was out of work for a few months and being a single mom it hit me hard financially . i did fall a little behind in lot rent, Before my rent was due this month i did owe the management 194.00, which was an accumulation of 2 50.00 late fees from paying my lot rent 2 days late the previous 2 months ( I have to pay my rent based on my pay date) and last month i paid a little less on my lot rent, On April 1st I gave them a money order for $410 which is my lot rent and they refused it saying they cant accept a partial payment, I will admit i did not try and work out a prior agreement to get caught up on the 244 i owed them, That was laspe of time on my part,,,,,anyway,,,,,,Now they are refusing my lot rent which was due on the 1st and charged me another 50.00 late fee because i didnt pay the balance in full. I have emailed them and asked if they can accept my lot rent check and a partial payment of the 244 which I now owe them and i will make sure the rest is paid no later than may 3rd when i get paid again, she said absolutly not because eviction papers have already been filed. I just find it hard to believe that in the 10 years i have never been late on lot rent except twice and in her emailed response to me she did admit that i have never been late and she does see that at least once a year i have paid several months in advance on my lot rent. im just sidelined and a little stressed, this is the last thing i need is an eviction. I am just now getting back on my feet,
I guess what i want to know is can they really refiuse my lot rent for this month? wouldnt that be considered seperate from the late fees i owe them? I am not disputing anything I owe or the fact I owe it, But thier refusal to accept my payment has cost me another late fee and i have to take the money order back to my bank and get a certified check because they are no longer acepting money orders, its not a big deal but its just extra time and money i honestly dont have and i just think its silly to lose my home over 194.00 well now its 244. but still, Im just hoping if this doees go to court the judge will see my history and not evict me,
