    Oh for heaven's sake, nobody bashed you. YOU stated that your child would be "mentally destroyed" to find out that the guy he knows as Dad isn't Dad. The TRUTH of the matter - whether you like it or not - is that you lied to the child, and any trauma would at least be in part because of that lie.

    You're welcome for the legally accurate, concise information I gave. Which includes this bit: Yes, Dad needs to agree to the adoption. If he doesn't, it's not happening.

    And trust me when I say this - you were treated FAR more kindly here than you would have been on at least one or two other legal sites.

    No, you don't get to adopt the child out from under him. Bio dad will at the very least have to be notified and have the right to object to the adoption or to seek custody of the child himself. Now with that said, if he hasn't had contact in 6 years, the court probably isn't likely to find that dad has the child's best interest in mind, and CAN grant the adoption, even against dad's wishes. But dad IS entitled to at least notification (and in all honesty, if he's not seeing the child but is paying support, he may be very happy to not take advantage of his ability to be heard - he may just be glad to get out from under the support payment).

    Sounds reasonable . I am sure he would love to get out of the payment and we do not need or want it . Nice to get a opinion and a little help towards the right direction for the entire family that is affected by this without personal dig's as nobody's perfect and we all make mistakes . We tried very hard from the very beginning to get bio to be a part of the child's life and he never showed interest till now . Adoption sounds like the route for child and us . Thank you ~ .
