    Exclamation Am I Eligible to Become Emancipated

    My question involves juvenile law in the State of: North Carolina.
    I'm 17 and I will be 18 in less than a year. I am still in High School. I have always considered the emancipation option but i have never really actually thought of pursuing it, until now. I would really like to talk to someone who can help me and talk to me about my situation. I would post more on the thread but I am afraid that it will reveal who I am and I want everything to be confidential. I need help, I would like to know about the emancipation process and get more details about it, if you have any advice for me, will you please post a comment to my thread and help me, and if you would like to continue talking to me about it then also include your email and I will write to your email address given, because i will not give my email out on this thread or any thread for that matter, I don't wish to reveal who I am.

    Do you have an income sufficient to pay 100% of your own expenses; a budget to show the judge your earnings, your expenses, and how one will cover the other; a stable place to live independent of your parents and is not with your boyfriend/girlfriend and/or his/her parents; better than average grades; and a reason that is not related to real or alleged abuse (regardless of whether it is physical, mental or emotional) and which represents an actual NEED, not just want?

    I Have 2 jobs and I'm a full time student. I do not wish to post about the living situations on here because of confidentiality reasons. I have been told by therapists and counselors that my living situation isn't healthy and maybe I should start thinking about ways to get out. I will discuss the living situations with you in a email rather than on here, if you wish to post your email, I will message you and let you know about it in more detail. I am new to this site and I am still trying to figure it out. Is there a way to write a message to just you and not let other's see it?

    Here is the law for emancipation:

    Note that not getting along ain't enough.


    In determining the best interests of the petitioner and the need for emancipation, the court shall review the following considerations:
    (1) The parental need for the earnings of the petitioner;
    (2) The petitioner's ability to function as an adult;
    (3) The petitioner's need to contract as an adult or to marry;
    (4) The employment status of the petitioner and the stability of the petitioner's living arrangements;
    (5) The extent of family discord which may threaten reconciliation of the petitioner with the petitioner's family;
    (6) The petitioner's rejection of parental supervision or support; and
    (7) The quality of parental supervision or support. (1979, c. 815, s. 1; 1998‑202, s. 6.)


    The chances are good that you will be 18 before a court even rules on it so you might simply consider waiting until then.

    Oh, and if your plan on living outside the home includes living with a romantic interest, that'll torpedo things almost immediately.

    I don't wish to have anything to do with my family anymore. I have put up with the way they treat me for 17 years and I'm tired of it and can't take anymore. I feel like I'm in prison when I'm home. Many people think my life isn't that bad but when they take a close look, they realize it really is like i say it is, awful! I have had multiple professional counselors and therapists tell me that it isn't healthy and that I need to look at ways of getting out.

    In my inbox, it says that cbg can no longer receive my messages because cbg has to delete other messages to make room first.

    I'm sorry, but those are not reasons to be emancipated.

    The very second you turn 18, you can leave home and live wherever it is you wish to live. If your living situation is that bad, your counselors are mandated reporters and would have made a report to child services.

    Clearly it is not a situation that required police or child services involvement. You may not like it, but it may not even be enough to compel a judge to remove your parents' custody.

    DSS has been involved many times. school counselors have reported many things to DSS. DSS has done many investigations and thought of removing the parental rights. I have always lied and said everything was fine when it truly wasn't. I went through depression and I am diagnosed with depression from the house hold living situations.
