My question involves an easement in the state of: Maine
I own surveyed property that includes the majority width of a private road. My neighbor to the west owns the remainder. The town doesn not claim it as a road, and states that it is private property, however the town has issued addresses and named this "road", stating that they are mandated by the state in order to comply with 911 standards. I found that there is no such "mandate", it is a recommendation. There are no legal easements on my deed that say anyone has a deeded easement through my property to access this "road". The town has purchased a road sign and erected it on my neighbor's property. The sign is a regular street sign, without any indication that it is a private road. We feel that the town is giving the public the impression that this is now a town road, which it isn't. Their answer is to shrug their shoulders and say,"It has nothing to do with us." The fallout from placing this sign the way it is will be up to us to deal with. Does the town have an obligation to put up a sign that makes it clear that this is not a town way? The road commisioner states that he has a variance that allows him to place the sign without permission. I understand that the town has an easement for repairs, but does that include permanent signage? I can't find anything in the law that spells this out.
