    Exclamation What to Do After Probation

    My question involves criminal law for the state of: Georgia

    I have already went to court and I was given a pre trial diversion sentencing. March 20 was my last day on probation and I have met all of the requirements. I received a letter to pick up my bond money. I'm not sure what to do next. Will I receive a letter of dismissal or expungement? What should I do with the packet? Can I get my arrest record erased? When can I state on job application that I have never been charged with a criminal offence? And since my dad payed my bond with cash am I able to pick it up? We.have the same address and last name.

    I don't recall if the courts send you a letter or not.

    Anything related to your case including successful completion of PTD and anything having to do with paying off any civil demand should be kept forever. While rare, screw-ups in the courts are not unheard of. Wouldn't it be crappy if you thought everything was taken care of, threw out all your records and then found out a mistake was made? It's very hard to clear things up without proof.

    No, you cannot get your arrest record sealed. See OCGA 35-3-37(d)

    You cannot ever state that you were never charged with a crime. The record of your arrest is permanant. You can only state you have never been convicted of a crime.

    I'd be willing to bet that the bail bonds people will only want to release it to the person who gave it to them but you can ask. Why can't dad do it? Cause if you take it without his permission well....you'd be headed back down a familiar road.

    Well my dad was.working and the clerk let me pick up the bonds money. And my PO told me to wait for a letter to come in the mail and see the correctional center to get the arrest record and criminal record restored.

    Then your PO was mistaken about how PTD/First Offender works. Again, see OCGA 35-3-37(d).

    Well on the contrary, after reviewing the terms of my PTD. It says terminate upon completion and I'm eligible for expungement of OCGA 35-3-37(d)
