    Default Does Establishing Paternity Give You Custody Rights

    My question involves a child custody case from the State of: Michigan

    Does signing the birth certificate and an affidavit of paternity give automatic custody and visitation rights to the father or is that something that is established through the courts?

    If the parents are not married, then dad must go to court to establish custody and visitation. Either parent can file for child support.
    DNA testing is strongly recommended prior to signing the affidavit of paternity, even if you know who the dad is.

    If the parents are married, mom and her husband (whether he is bio-dad or not), have equal custodial rights to the child.

    But is that the current law as of 2012? I have been told the laws have changed.

    Signing the birth certificate only takes care of the step of establishing paternity (which can still be challenged). An unmarried father has no form of custody that can be ENFORCED without a court order. Period.

    my in-laws. I have a brother-in-law who has bullied his girlfriend and mother of his daughter to believing he has custody of their daughter. My mother-in-law also believe him. I wanted to get my facts straight because I didn't think any of that sounded correct. Thank you for the info it was very helpful. Do you know a web-site that states this issue so that I have black and white proof.
