    Unhappy Wrongful Collection on My Credit Report

    My question involves landlord-tenant law in the State of: Mississippi

    About three years ago, I lived in this student housing apartment complex. My rent was is good standing and I was never late. In July of 2009, my lease was up. However, in February of 2009, I renewed my lease. In June of 2009, I was offered free room and board at the University for my scholastic achievements. Naturally, if I could live on campus for free, that was the ultimate choice. I notified my landlord before I moved out in June 2009. However, in August or September 2009, she claimed that I "left without reason" even after I told her I would attempt to find someone to sublease my apartment. I did not find someone to sublease my apartment but she did, so technically there was no rent revenue lost. In 2010, she entered a collection of $6000.00+ on my credit report (she accelerated the rent for the whole year). My question is: is that legal? If not, what should I do to clear this from my credit report? It is difficult to find an attorney in Mississippi who practices in Landlord-Tenant issues. Please help!

    You can dispute the false information to the credit reporting agency, but I would not be surprised if your landlord confirms the information.

    Did your landlord ever obtain a judgment against you and, if so, is it the judgment that was recorded?

    If your landlord is reporting false information to a credit reporting agency, you may have a cause of action under the Fair Credit Reporting Act (FCRA).

    Well I've learned that the apartment complex has come under new management. One of the workers there claimed she could not find any information related to me (she probably didn't look or management may have this information). There was never a judgment entered against my ex (who co-signed) and I. Do we need to seek an attorney. I don't want them to take us to court and have an ugly judgment on my credit report, especially for something I feel I don't owe.
