    Default Non-compete issues in Michigan

    I have a non-compete contract for a 12 month period. In short I am wanting to change jobs and have been offered 2 jobs with competitors and they reqire me to obtain a waiver or written letter from a licences Michigan attorney the non-compete is not enforceable and/or advise. The company has not enforced this non-compete on others which have left the company. The company has not performed resonably to support me as was a written in condition to the agreement. Also it was modified removing the statement this clasue would not effect my income ability and replace with in accordance with applicable law. The agreement is so broad it covers all areas most of which I was not involved in. There is no specific region of limitation. Can you give me advise to this? Secondly, if the employer does not willfully give me a waiver of non-compete concerns being their agreement is unreasonable in content, if I loose the job offers as a result can I sue the employeer for damages of this loss. Please advise.

    The waiver would have to come from your employer; for an opinion letter that the non-competition agreement is not enforceable, you would have to retain a lawyer.

    Your employer's path to enforcing the contract would be to commence litigation against you. You could respond within the context of that litigation by contesting the validity of the non-competition language.
