    Default Probation Violation and Jail Sentence of 30 Days

    My question involves criminal law for the state of: WA
    Hello,
    My husband had an old charge that he was was on probation for a year for. In the mean time he got in trouble for shoplifting although he was going to contest not guilty to that charge. The judge just gave him 30 days of jail for a probation violation. We have 3 children and both of us go to school full time. He will have to drop out of this quarter. Although we sent letters to the judge asking for home monitoring so he can continue school and help with the kids the judge denied the motion. Is there anything we can do? Can we put the information in front of another judge?

    A violation is a violation. It's not the same as having to prove guilt for a criminal offense. Not much you can do. A violation goes before the sentencing court.
