    I do have experience in the US; I attended a workshop with a recognized scientist at University of California and put it in my resume. Apparently not good enough experience for them.

    Hell, I have friends from school that are working for Google and Microsoft in the U.S. and they aren't even U.S. Citizens they gave them work visas and they didn't have any "U.S. experience".

    The employer wouldn't be denying the job based on their national origin, but on their education. There is no evidence that the employer has denied, nor intends to deny anyone based on their national origin.

    I'm not speaking about this specific OP. Just commenting on what I thought was interesting food for thought. I stand by my statement that rejecting a candidate based solely on his/her having grown up in another country and obtained their education there could provide the basis of a national origin disparate impact claim.

    I understand. I would agree only if the company had a policy that restricted the countries (ie. company won't accept African degrees but will accept Asian degrees). I think that if it is a blanket policy that restricts any non-U.S. based degree's then it would be a safe policy.

    A "workshop" is generally not considered as experience.

    If you're friends found jobs there, then go work with them.

    Ok, how about making this easy:


    "Unfortunately, they will only consider non-US college degrees if the candidate has a good amount of US work experience, and they do not feel that you have this experience."
    a workshop is apparently not a "good amount of US work experience" in the eyes of the prospective employer. Typically a workshop is not considered work experience at all. It is training.



    Beth3; I understand your point and agree. It goes along with what Mr K said:

    They cannot discriminate based on national origin of the person, but the degree is something else entirely. If they were selectively targeting certain international schools as a pretext for some form of racial or ethnic discrimination, that would be one thing. If it's every international college - "Sorbonne, Oxford? Sorry - you don't have U.S. experience" - that's not going to be a case you can make.

    They are choosing not to accept your degree because they choose to and it is not illegal.
