    Default 16 Year-Old with a Very Successful Job, but Abusive and Controlling Biological Mother

    My question involves guardianship in the State of: Georgia

    Now, I am a very well-rounded 16 year-old young woman with high hopes for my future. I work at Cracker Barrel, bringing home almost $500 in just tips, when I work on the weekends. On average, I make about $3600 a month on my own, with no help from my mother or departed father. I live with my 19 year-old boyfriend, who is very supportive in every way. I am currently still in high school, and I plan to obtain my degree in Obstetrics as soon as I graduate, but first becoming a CNA until I graduate from doctorate school. Although I am very aware that I have all of this going for me, I want to get emancipated from my biological mother. She's clinically Bipolar, and hasn't taken her medications in years. This has led to many verbal abuse confrontations, resulting in her calling the cops on me, to say the least. As stated above, I don't live with her, but I often have to rely on her for medical appointments and school related activities that involve my legal guardian.
    Emancipation would allow me to get an apartment, like I have attempted in the past, let down because of the fact that land-lords won't lease to anyone under 18. I am aware that once I could become legally responsible of myself, I could get my own apartment and take care of all of my financial needs. This procedure would also allow me the opportunity to take myself to medical appointments, without the interference of my mother.
    I have all of my personal information, such as my birth certificate, driver's license, etc.
    How would I go about doing his exactly? Would I have a high expectancy of being approved or let down?

    I have been living out of my house since September of last year, about a week after I turned 16. I will be 17 this upcoming September, making it a year.
    Is that long enough? Or is there a specific time range that they prefer before approving these types of allegations?

    It has nothing to do with your allegations, and everything to do with you needing emancipation and having a proven track record of being capable of supporting yourself. If you've been doing so for a year, and you can prove it (rent receipts, paycheck stubs, tip records), you'll have a better chance than most.

    Very few emancipation petitions are ever granted. A proven ability to support yourself will at least get the petition heard. Then it's up to you to persuade the court that it's in your best interests.
