    Default Getting Off Probation

    My question involves criminal law for the state of: Pennsylvania


    Hello, I am to be done with my probation on 4/5/12, that is my max date. I still have court costs and restitution, I do have a payment plan set up through the courts and have been paying every month. My last probation officer visit was on 3/28/12. She did not have me sign anything or give me another appointment date. She simply said I will not recieve any paperwork in the mail saying im off probation until all my court costs are paid. So does this mean I am really not off probation? Does this mean if she wants to call me in, in 5 months to talk to me she has the right to? I always thought a max date was meant exactly as that when you hit ur max ur done. Any help would be appreciated, thank you!

    You don't want to think, you want to know. My department will send the caase back to court and request an extension. If the court wants, it can extend your case and put you on nonreporting status. In your case, it sounds as if you are in nonreporting after you reach 4-5. You need to check with your PO and ask exactly what happens if you are not paid in full. They may be planning to violate for failure to pay. They may keep you in nonreporting and reactivate your reporting status if you are ever arrested again for a new offense prior to completing your financial obligation.

    Thank you for your reply. A couple details I have left out, for the five years i have been on probation I have paid over $6000 in costs and restitution. I currently have around $9,500 to pay, which was impossible to finish by the end of probation, I do have a full time job and currently pay $125 a month, with what I have left over from my check its just enough for me to get by. My PO is very short with me and really wont give me much information. When asked what happens from here I was simply told that I will not recieve my papers that I am officialy off probation until I complete my court costs. She also said you will not have to come back to my office? I just wanna know if she wanted to call me in, in 1-2 months or whatever amount of time for a meeting or a drug test, can she legally do that even tho my max date is up? And no im not doing drugs or going to do drugs, I just really wanna put this behind me, as it has been a long 5 years and I just wanna move on with my life and finally not having someone telling me what to do and running my life.

    If your state does not consider you complete until you meet the conditions, then yes. I don't know PA conditions, so I'd feel that I would do you a disservice by saying that she can't. You have the power and the right to know what they can and will do to you. Ask her. If she does not answer your question to your need, then ask her supervisor.
