    Post Charging Somebody for Petit Larceny

    My question involves criminal law for the state of: West Virginia

    anyone here who can give good advice, suppose im intending to charge somebody for petit larceny... should i go to cops or file that to the court?
    whats the step? what to expect? anyone who had done the same?

    any input will be appreciated!

    I've done it both ways many times. I would try the police first. At times, I've bypassed the police and filed directly with the prosecutor's office. At other times I've filed the police report and they declined action and went directly to the prosecutor and successfully filed a charge.

    But like I said, try going to the police first.

    thank you for the input.. i might have to go the prosecutors office because the cops simply sent me to the magistrate when i asked. and when i went to the magistrate i was sent to the police, and then instead i went to the sheriff,

    all in all i was told if i want to file civil claim. just the magistrate clerk handed me a form, and if i want to file criminal charge i have to deal with it with the police.

    the game system i purchased was for my house for whenever my son is with me, had a little financial problem, so i had to pawn it, but when i was ready to get it, pawnshop said my ex came and got it, and in order for the pawnshop to release it to her, she went and told them that i stole it from someone,
    im not worried about being accused of that, coz it was me who paid and got it and i got receipt and stuff that it was mine.

    Will i be able to charge her, if she uses that she went and paid for it from the pawnshop because her intention was for our kid to use it,
    nobody sent her to do that, as i was there to get it but she did it before i was ready to do so, and now she refuses to give it back.
