Default Can Stepparents Be Ordered to Pay Child Suport

My question involves a marriage in the state of: Georgia. I am seeking a divorce from my second husband whom I married in Dec 2007. He has been mine and my son's sole support the entire marriage. He became verbally and emotionally abusive two years into the marriage by falsely accusing me of affairs, and generally just hateful behavior. He is a good provider, but he is emotionally/verbally abusive and, I just recently found out, is himself a cheater. The only real proof I have of this is where he has subscribed to internet porn sites where he chats and possibly meets with local single women. We separated once before in 2010, at which time I moved away to another county for three months but we still saw each other fairly often. We reconciled in Jan 2011 and have been living together ever since. He claims to have proof of adultery on my part, but there cannot be any proof because I have not committed adultery, other than hearsay. What kind of proof is admissable? Are the subscriptions to internet porn sites considered adultery? We are currently separated since he has thrown myself and my son out of the house again, and we have no way to support ourselves. Another issue is with the checking account, he had my name removed from the account yet allows me to use the debit card and sign his name on checks for groceries, household expenses. Every time he gets angry with me he threatens to file charges. We are separated now, my son and I are living on my ex-husband's property which he basically abandonded along with his son and my lawyer is currently filing a contempt order and modification hearing on my ex-husband. My husband has made life unbearable for me and my son so we were forced to leave. He has actually thrown my personal belongings outside in the yard, destroying several items. Can a judge order him to pay some temporary support until I can get on my feet and can he be ordered to pay child support for my stepson whom he vowed to provide for when we got married?

Thank you in advance for your advice.

Your child's father is responsible for supporting your mutual child. Step dad owes nothing.

Thank you Dogmatique. In attempt to avoid double posting, there are several other questions in my post regarding my separation from my husband, son's step-dad. Son's biological father is not paying support, husband has made life unbearable at home forcing me to move my son to a more stable environment, and he has been our support for the entire marriage since 2007. We have no support and I do not have a job yet. Do I have any options?

Not in the slightest. Porn is not adultery, it's just porn.

How did he accomplish removing your name from your joint checking account without your consent?

Why is your son's father not paying support? You should be seeking child support from him. Unless your husband formally adopted your son, he is not at all responsible for supporting him - that's your job and his actual father's job.

As far as spousal support, you may be entitled to temporary spousal support, but the only way to know for sure is to file for it. You really need to be discussing your situation with an attorney. Contact your local bar association or legal aid for a referral.

I am consultant an attorney, as I mentioned in my post, we are in the process of filing contempt charges and a hearing for modification of support on my son's father for nonpayment and abandonment, but he cannot be located because he is running from a bench warrant. Add the double kick to the cods of a cheating husband who habitually accuses me of infidelity and the two of them are really putting the screws to me. I suspect his (my husband
    s) motive is to make life as difficult as possible in order to force me to leave so that it will not cost him anything.
