    Default Filing a Complaint About Unemployment

    My question involves labor and employment law for the state of: Massachusetts
    Hello Expert Law two things .
    I had a unemployment hearing today in Massachusetts,
    I don't know the result yet but I felt she didn't seem to care what I had to say and was very rude and bias towards me . Can I file a complaint if so how?

    Second What happens after I filed a complaint through the MCAD ?

    You likely wanted to present an emotional appeal, rather than a legally relevant one. She does not care about your feelings. She wants your side and the companies side. She then will decide what she feels actually happened and whether it qualifies you by statute.

    1.) A complaint about what? There is no law against being rude. She is not required to hang on your every word or be your best friend. She's got a lot of hearings after yours and part of her job is to keep things moving. If you really feel you must, you can write a letter of complaint but I strongly advise you to wait until you get the results first. If your claim is approved, you might want to rethink a complaint of bias. If your claim is disapproved, you have the right of appeal. You might want to keep in mind that even if you write that letter you will NOT be told whether any action is taken and if so, what action it is.

    2.) MCAD investigates and reaches a decision. What more would you like to know?

    No law, but I'm sure that there is a policy concerning it. I would wait like cbg says .. it will give you time to reflect & also get a result .. this is your first encounter with the dept. ... get the initial claim settled and then move on.

    Sooner or later the person will meet someone who is not as nice as you.

    With rare exception, all of the UC hearings I've attended (representing the employer), the Administrative Law Judge has seemed to be impatient and not exactly "warm and fuzzy" towards anyone appearing - employee and employer alike. ALJ's aren't required to be "nice" to anyone. Just to take testimony, evaluate evidence presented, and make a decision within the law. I supposed you can send a letter of complaint to the UC Divisioin that the ALJ wasn't nice to you but it's not going to get anywhere. I suspecting being a UC ALJ is a real "burn out job" for those attorneys who do this for any length of time.
