My question involves guardianship in the State of: Texas

I'm sixteen and want to become emancipated. I live with my mother but in a few months she plans on moving to Houston which I do not wish to go. Since my parents are divorced I have the oPtion to live with my dad but he's in the process of finding a place to live, I don't know if it will be suitable for me. I also want to finish my high school years at the school I attend now. My mother and I do not get along well and she would prefer me to not have a social life. My dad is fairly laid back but agrees with my mom about my social life so I will be taken out of my current school. I don't have a job but could get one easily, I have an aunt who has offered me a place to stay, but my mother isn't pleased of this idea, any way I could get emancipated or live with my aunt?

Not a chance in the world. You have to already be living alone and supporting yourself. The best bet is to lobby your parents to allow you stay with the aunt.

Agreed. In your state, at the age of 16 unless you are ALREADY living on your own and providing ALL of your own support, you do not qualify for emancipation. (BTW, "I don't want to move" is not a valid reason for emancipation in any state or at any age under 18.)

If your parents will allow you to live with your aunt, AND if your aunt agrees, then you may. If they do not agree or if your aunt is not willing to take you, then you may not. There is nothing, and I do mean nothing, in the law that will force your parents to allow you to stay where you are if your parents do not wish you to.
