My question involves criminal law for the state of: WEST VIRGINIA
Hello Everyone.. So i followed the advice i got from here..
Yesterday I went to Magistrate court, Explaining that I pawned something and when i was ready to pay and get my item, The Pawnshop owner told me that Someone already came and paid and got it, with the excuse that i STOLE it, which wasn't true, because i bought and paid for it. next thing i know i found out that it was my ex wife who went and did it. I have also tried to compromised and work things out with the pawnshop owner, However, the pawnshop owner would always tell me to come back, because he would wanna talk to the person whom that was believe that i stole the game system from, whenever i call the pawnshop they would tell me to call back, when i go personally they would tell me they haven't talk to the allegedly owner the game system, So i went and ask the person to whom they said that i stole the game system from to call the pawnshop for me, and no luck herself, pawnshop owner can't be reach.
So anyway.. Magistrate said that i could file a small claim for it, but wasn't sure who should i sue, the one who came and got it, or the pawnshop owner. So i was ask to go to the police station, Police said that i should go to the magistrate and see whether it's a civil lawsuit or criminal charge, i told the cops i just did. then i was ask to go get a lawyer, LOL..
I went to the sheriff , sheriff told me go to the cops and ask if it can be considered as a pety theft.
This is frustrating.. If you were in my situation, what would you do? let it all go? or pursue the case to teach my ex a lesson as well as the pawnshop owner for just ignoring my kindness and cooperation.??
NOTE: I AM NOT AFTER THE MONEY, NEITHER EVEN THE GAME SYSTEM ITSELF. Now it's just about teaching them a lesson, because i am so pissed that i was not only accused of stealing my own thing, But also no police report that i stole it, pawnshop simply released it, and my ex for doing what she did.
Sorry if it seems immature and childish.
ANY ADVICE?
can it be considered as a pety theft? can i charge my ex for that? When charged and found guilty for the pety theft , what's the conssequence?
