    Question Small Business Income While on Unemployment

    My question involves unemployment benefits for the state of: NY
    I worked for a company in NY but have always lived in FL. I've been getting UE from NY for over a year and a half (part of 2010 and all of 2011). During this time I've also had a small business which nets 10-15k a year. My tax accountant said they could possibly ask me to return all 20k of UE benefits paid to me. I was under the impression that as long as I wasn't making as much as they were paying me, that I was still allowed to collect. In other words, since I wasn't making much money I was still allowed to collect. Is making any money at all while on UE a definite no-no? What are the actual rules on the issue?

    that you report all income to the UI folks. Did you? If not, you have falsely filled out your vouchers and may not only be liable for repaying the UI but there could be additional fines.

    They are filled out online. I don't remember all of the questions but one that stick to mind is "Have you returned to work full-time?" Which I have not. Anyway, Is making any money at all while on UE a definite no-no?

    No. Making money while on UI is not a no-no. What is a no-no is not reporting ALL that income.

    There's no place on the weekly form to report it. I would think that reporting income at the end of the year in taxes would count as reporting it. Anyway, we've established that you are allowed to make some sort of income while on UI. Now the question is, HOW MUCH?

    No. Reporting income at the end of the year in taxes does NOT count as reporting it.
