    Default Mother and Brother Went Back to Mexico, but Regret It

    I am an american citizen and I just got my husband his residence about a year ago. My mother-in-law and brother-in-law were here in the u.s. since 2003 and they tried fixing their papers with the mothers husband but they were denied. They were appealing the case when my mother-in-law split with her husband and she ended up going back to mexico. My husband plans on applying to fix their papers as soon as he is a citizen also, but we want to know if his mom will be able to or will they give her a consequence of 10 years probation for leaving the country? I really miss my mother-in-law and brother-in-law and want them back here so bad. And we will try and do what ever we can to get them back but we would like to go the legal way about it. If you know anything that can make this process easier please let us know. Thanks for reading.

    They have to wait out any ban they are assessed unless they can qualify for a waiver. You have posted nothing that indicates they would qualify for a waiver if it is an option; you missing them is certainly not a reason.

    They should NOT attempt to reenter illegally; they will greatly damage any future processing possibilities.

    You have not posted enough specifics of the case to advise you further. The options are very much dependent on entry type and times of illegal presence. Consult an immigration attorney with their complete immigration history and paperwork from any immigration proceedings. There is no easy - or cheap - way.

    would it be easier to start the process while they are still in mexico?

    It appears they have already documented their illegal status here. They will be subject to the 10 year ban. It does not matter where they are now.

    They MUST remain in Mexico until they are either granted a green card or a visa permitting them to enter. Since they have immigration intent, there are few visa options available to them.

    I suggest that you consult an immigration law specialist based on your questions. You really need a professional review of both your mother's and brother's immigration history. If finances are a problem, there are many social service agencies that will assist you with fees based on ability to pay.
