    Default Landlord Lost Rental Property to Foreclosure, Won't Refund Security Deposit

    My question involves landlord-tenant law in the State of: Texas

    The Bastrop wildfires took my house last Labor Day. I found a house to rent nearby. The landlord worked with me on getting in a rental house until I found something else and figured out what I would do with my life after the tragedy.

    The Landlord is also a real estate rep. He owned a couple of houses across the street from each other and rented them out. The house I was in had been foreclosed on. The landlord never told me anything and the new owner who bought the house in an auction put an eviction notice on my door. I called the new owner, he agreed to let me stay and I signed an acknowledgement letter from him, saying that he honors the lease now.

    I found a house to move to shortly after. I sent the original owner, with whom I had the lease, a registered letter that I was moving out. I also told the new owner.

    The original landlord refuses to pay and says that the new owner is who owes me the deposit. And of course the new owner says the original landlord owes me since I had the lease with him.

    Can someone please help. I have all the documents available to email or upload.

    You have told us that the original landlord took and kept your security deposit, and did not forward it to the new owner. Thus your claim is against the former owner of the property - the guy who has your deposit - not the new owner.

    Thank you for helping me, sir. I thought it might have been possible for orig. owner to be correct, since I got the acknowledgement letter of lease transfer from the new owner. Thanks again,
