    Default Hit and Run While Parking

    My question involves a traffic accident in the State of: Texas

    I was rear ended today in a fast food restaurant, while waiting in the line. The driver that hit me, was behind me and first attracted my full attention because of the loudness of their music. I looked in my rear view and seen a young lady, talking on her cell phone, and handing money to the cashier. She then disappeared out of view and that's when I seen her suddenly accelerate and come toward me. I had enough time to brace myself for the impact, which i excepted to be a pretty good jolt. However it sent my head into the steering wheel. I immediately started feeling a little pain in my upper back and of course my head was hurting slightly. However we were both sandwiched in and there was no way either one of us could get out to look at damage. So when it was finally my turn, I pulled up past the window, she proceeded to get her order, then speed past me. I was able to snap a picture of her lic plates number. I did not get out of my car because i wasn't feeling to hot.

    My question is, is this to be reported as a hit and run? I was told that because of where it happened, there is no liability. However what about how it happened? I'm not going to go after her, I'm basically asking out of curiosity. I can't imagine, how someone could get away Scot free. What if my injuries would have been worse, then a bruise or achy back? her car received all the damage, in the situation. I have no clue if she was hurt...could she come after me for anything?

    If somebody hits your vehicle causing damage or injury and leaves, you may file a police report.

    You should have immediately reported the incident, but should do so now if you haven't already. Just because it happened on private property does not eleviate the driver from responsability.
