    Default Modifying Special Conditions of Parole

    My question involves restraining orders in the State of: California
    In 1998 my husband was arrested for DV and ended up on probation, there was never a order of protection between us but I left shortly after. In the years that followed he was sent to prison for not attending DV classes and then again for another of DV altercation with someone else. Here we are in 2012, I need help with our son but it shows on his 'special conditions' of parole that we are not allowed contact. What do we do to have that modified, removed. exspunged, or changed? We are still legally married.

    No by help I mean getting the special conditions changed so we can have contact in a family atmosphere without the risk of his parole being violated.

    I hate to ask this, because it's a delicate issue. But has he violated already? Your son has gone..how long, without contact with his father? Why is it an issue now?

    (Yes, it may be asked in court)

    We want to work out our marriage and live as a family. We were allowed to live together until I left and he went to prison for not attending classes then it became a 'special condition', that was about 9 years ago. Since then it has been and is on his last release papers when I wasn't involved.

    Personally, I will never answer questions about modifying orders pf the protection over the web. You need to go to the court or whomever issued the OOP and discuss your desires. For all I know, you could be the respondent. Whomever issued the order will be able to answer any question you may have.
