My question involves a traffic ticket from the state of: New Jersey in Jersey City on the intersections of Montgomery and Country Rd (father's 2 violations) and Kennedy Blvd and Communipaw Ave (my violtion)
Hi I received three notices (let me explain) in the same vehicle, registered/mailed to the same name on three different dates. The first two notices came together in the mail on 2/22 and involved my father as the driver (although I don't think they care who the driver is, correct me if I'm wrong). The third violtion occured by me on a different intersection at 2/10 and because the first two warnings were used up automatically incurred a ticket of $85 for failure to observe traffic signal 39:4-81.
I am wondering since this involved two different drivers, I was not informed of the first two violations in mail before the third one even occured and made a 'rolling' right turn without stopping (but without traffic on a clear road without any 'no turn on red') , what is the best route to proceed? Although I can't find the specific law, rolling red turns aren't permitted in New Jersey (39:4-81c anyone)?
Also what consequences does paying the $85 involve as far as points and possible surcharges? Is there a good chance that if I argue this ticket that I could get out of any points and just pay the fine? How would I do so?
Also if it matters, the person the ticket was sent to has NO points and no traffic violations for the past two years
