    Default Getting Married in the States Without Immigrating

    I would like to get married to my fiance in the USA because I am American and all of my family is there. We currently live in Canada. What I would like to do is get married this August in New Jersey and then return to Canada where we both have jobs and my fiance is also in graduate school.

    We would like to apply for a green card for him once we got back to Canada (maybe in December), but when we actually get married in the USA we have no intention of staying there at that time. Is there anything wrong with this? Would we be allowed to get married in the US without the intention of staying there?

    You need to make sure that you're marrying in a state that caters to tourist weddings - that is, you need to make sure you'll meet the residency requirement of the state. Lots of states cater to tourist weddings where one (or both) of the people getting married is not a U.S. citizen.

    The rules for NJ when neither person is a resident of the state, is that you must be married in the municipality that the license is issued. Normally if you were NJ residents, a license issued in Bellview Bourugh would be valid anywhere in the state, in your case it would be valid only in Bellview Bourough. You must apply, with proof of identification, at least 72 hours before the ceremony (and no earlier than six months before the ceremony). Make sure you call ahead and know what the hours of the license office is in the municipality that you using.

    You can get the list of license registrars and the application here. Do NOT sign it in advance. It has to be signed (by the two of you) under oath in front of the court official.
