    Default Possession of MDMA

    My question involves criminal law for the state of: Michigan

    Two days ago I was pulled over with several empty beer cans and a pill of Molly (MDMA) that equalled about .1 gram. Let's just say I got let off EASY. I had to call my parents, they picked me up, and we went home. I was not arrested, charged, not even a ticket. I have never been arrested. However, my mom and dad name dropped and it turns the person they said called today and said the officer may be having second thoughts about the felony drug charge. What could be the possible outcome? He did let me go at first, can he bring it back up? I'm never doing anything wrong again. This mistake quite possibly may have destroyed my future and I am very grateful that it didn't thus far.

    We have no way of predicting the future for you. If mommy and daddy get you out of a charge by name dropping, consider yourself both undeserving of the break and very lucky.

    If you commit a crime, you can be charged with that crime up to the time the statute of limitations runs, which for a felony in Michigan is generally six years.

    Michigan has a very long statute of limitations, even on misdemeanors, but possession of MDMA is a felony. They have SIX YEARS to charge you. The catch and release doesn't get you off the hook on later charges.

    Honestly, this has changed my life. I don't think I will be doing anything against the law for quite some time. If I somehow get the "nice cop" that lets me go, there is no way I will ever go back to what I was doing. I am too smart and have too much going for me to jeopardize my scholarships, financial aid, my career goals, etc. I've disappointed myself from all this. For now, all I can do is pray that everything works out and I learn a great lesson from this. If the cop ends up deciding to charge me, I don't know what I will do. Everything I have ever accomplished in my life seems like it won't matter if the felony is pursued.

    You would talk to a lawyer about a deferral under MCL 333.7411, a much better solution than complaining that your life is over.

    What did the officer do with the pill? I know he didn't give it back to you. Did he throw it on the ground and squash it with his foot, or did he take the pill into his possession?

    Then you could be charged at a latter date with the crime.
