    Default FBI Record Expungement

    My question involves criminal records for the state of: Kentucky

    I was arrested for a felony and plead guilty to a misdemeanor in Kentucky. I was successful in having this voided and sealed. However, it still showed up in the FBI rap sheet when I applied for a job. I have a court order stating all records are to be sealed, including NCIC and law enforcement agencies. Will the FBI comply with this order? This is the only thing standing in the way of my employment. Thank you for the help!

    The FBI, being a federal agency, is not obligated to modify its records in response to state court orders. It generally will update its records to reflect state court expungements, but that's done at the agency's discretion.

    Also, if it is your responsibility to forward your sucessful motion to the state police(they are responsible for your record being sent through the system, that could be another reason. In order to have thinge removed in IL, you need to have your motion granted by the court first. Then, you need to have that motion forwarded (along with a processing fee,) to the state police. They will inform you that they received it and they will also tell you if they are able to comply with the judge's order. If they are not, then you are stuck with trying to figure another way out of your situation.

    The FBI will update the disposition status to show the expungement or sealed status of the record. However, the record will still show the arrest and conviction.

    It might have something to do with you pleading guilty. Maybe the FBI has a policy on this. Someone from the DPS legal department may be able to explain what happened if it's a policy issue. The FBI told me that if the Texas DPS honors an expunction order then they almost always clear the record. You can only expunge non convictions in Texas though.
