    Default How to File for Divorce

    My question involves a marriage in the state of: Ohio

    This question pertains to my father. My father was in a relationship with a woman after his divorce from my Mom for about 3 years before he married her in 2004. Two years later his job was transferred to Florida so they moved . UPon selling his condo ( this was not in her name as it was bought when my MOm and Dad were married.) he found out there was a 13k lien on it as she had not been paying the mortgage. I'm not sure what lie she told him but he paid it and they lived in florida together for about another year. In 2006 my Dad started noticing odd things ...long story short he found out she was an alcoholic and gambler . She had taken out tons of credit cards in his name, stopped paying their rent in Florida to where they got eviction notices. She pawned her wedding ring , the tv and countless other items. In 2007 my Dad and her decided to go their seperate ways and he took a job in Maryland. Since being seperated he has taken job transfers in three other states but has now moved to Kentucky where he plans on staying. My question is how does my Dad file for divorce from her now that he has a permanent residency. As far as he knows she is living out in Arizona with a new boyfriend. I worry what will happen if he should pass away. If he is legally married to her would she be entitled to everything regardless of what his will says?? Would she have a say in his medical care or where he is buried??? Any info would be helpful as I need to get my Dad in teh right direction to formally file the divorce papers and get this lady out of his life once and for all.

    He files for divorce in the county in which he is domiciled, and serves her with copies of the divorce papers. If his process server cannot track her down he can seek permission from the court to serve her by substituted service.

    If he chooses to remain married to her for the rest of his life, that does create potential issues for his heirs and estate when he passes away.

    What if he cannot find her. Hypothetically let's say she is never served with the papers because she is not able to be located.
