    Default F-1 Visa Renewal After Petty Larceny Dismissal

    Hi,
    My friend was arrested last year for shoplifting (petty larceny), pictures and finger prints taken, he served Community Service and case dismissed in January after ACD. His student F-1 Visa expires in June, he needs to get it extended for course completion. He plans on visiting his home in May so will need to go get a Visa stamping. Was wondering what should he answer on the Visa Application Form of whether he was arrested before? Also, will his finger prints show up at the Visa Office and at the Port of Entry? Should he confess to crime or the records have been dismissed so nothing will show up and he can avoid confessing?

    You told us that he was arrested so the answer to the question, "Have you been arrested" would be "yes". Any answer he gives should be truthful. If your friend is concerned that his criminal conduct will affect his visa eligibility he should consult an immigration lawyer.
