    Default Fired for Missing Work Due to Headaches from Bad Eyeglasses

    My question involves medical malpractice in the state of: Iowa

    I received the wrong eyewear prescription from my new eye doctor last year. The new ophthalmologist examined me and wrote up my eyeglasses prescription that included astigmatism. After I purchased a pair of glasses with the new prescription, I began to get headaches and blurry vision, which caused me to leave work early and impacted my work performance. Prior to the new glasses, my work performance was meeting expectations and I was feeling fine. Ultimately, I was fired to due to poor work performance.


    Seven months later, I come to find out that I don't have astigmatism and was written the wrong prescription.
    I was planning to reach out and see if the doctor will pay for a new pair of glasses but wanted to see if I should be asking for more given the job situation. Or do I have an actual malpractice case?

    Any advice would be appreciated.

    Your remedy for an error in the production of your eyeglasses is to go back and get new eyeglasses that accord with the actual condition of your eyes.

    You are not going to be able to successfully blame the optometrist for your chronic absenteeism or termination.

    I couldn't agree more.

    You knew or should have known that you were having problems with your eyesight (i.e., headaches, etc) and that had an effect on your job performance. You apparently ignored the signs (or chose not to accept them) long enough that your performance suffered. That's not your employer's problem.
