My question involves labor and employment law for the state of: California
I said f___you about my foreman and it was reported to management from a single witness who heard it (She was a client under my direction) The foreman was not present when I said this. I was fired for insubordination even though I did not stop working, and also for abusive language "toward" foreman eventhough she was not even present. I was not abusive toward my client as she admitted in her interview. How is this called insubordination and what legally describes abuse "toward" someome if they are not present?
