    Thumbs up Resident for 6 Years, Ready for Citizenship

    My husband has been a resident for 6 years, he became legal through his first marriage. In 2010 he divorced his first wife and in 2011 we got married. Now he wants to become a citizen and my question is, what documents should we send with his application since he is becoming a citizen after being a resident for 6 years not for being married with his citizen ex-wife; we've been searching, but it always tells us information based on citizenship through marriage.

    Another question is, he is going to make a petition for me to become a legal resident, can we send all my applications with the citizenship application, or should we wait until he has his citizenship certificate?

    He also wants to bring his son from Colombia, his son does not have any status yet, and my husband was never married to his son's mother. How can he apply for him?

    Your husband needs to go speak to an immigration attorney. Did he have a conditional residence card? Did it get conditions removed? If not, he may not in fact even be legally present now, let alone qualified for citizenship.

    He's not married to a citizen. He needs five years residence (which he appears to have). The three years only would have applied if he applied to be a citizen while still married to the US citizen.

    What is your immigration status now? Unless you are here legally on an immigrant visa you don't qualify just because you're married to a permanent resident, it has to be a citizen. If you are illegally present, you've got other issues.

    Similarly for the son, he would need a immigrant visa, or wait until dad is a citizen.

    You should bring up all three issues to the attorney.

    My husband is been a permanent resident since 2006. He is ready for applying for citizenship.
    All i need to know is what documents should we send with his application since his applying for being a resident for 5 year not through marriage.

    You husband needs to read EVERYTHING here, here, and here.

    Then he'll need to file Form N-400 - he needs to read everything here, too.

    He really should consult with an immigration attorney during this process. It's a lot of picky paperwork, and if he misses something, he'll have to start all over again.
