My question involves criminal law for the state of: New Jersey
Over the weekend in New Brunswick I left a bar with a beer. I went to finish that beer, and a cop stopped me and issued me a ticket. A couple things wrong with the ticket, but I'm not really planning on fighting it, I just want to know what to expect in court.
First, the ticket errors:
1. Wrong address on the ticket - I have the address change sticker on the back of my license, but he put my old address on the ticket. Not a huge deal, and again, I'm not planning on fighting it.
2. No driver's license number on the ticket. I realize it's not a moving violation, so that may not be important, but how would this get tracked to me without my license number?
3. No statute listed on the ticket - The ticket says that "Defendant did consume and open 12 oz. bottle of beer" but no statue is listed that was violated. I've been trying to look up what the possible penalties are, or what specific law I even violated other than common sense, but with no statute listed this is tricky.
Anyone have any experience with public consumption law/penalties? It says I have a mandatory court date, but I live a couple hours away and really want to just pay this and move on. I've contacted the court, but the ticket isn't in the system yet so they couldn't answer any questions for me. What can I expect come court date, is it worth getting a lawyer (when the lawyer would possibly cost more than the fine), and are the errors on the ticket enough to make it worth fighting? No priors, other than a couple speeding tickets, this is my first run in with an officer. Thanks!
