    Default Child Support Never Ordered by Court

    My question involves child support in the State of: florida. My husband and I divorced in 09 with him as primary. He said he didn't want nor would ask for support. I continue d to see the children almost everyday. Until june2011. When he decided to only allow visitations on mon wed and one sleepover on Saturday. . Our final judgment did have this in it based on what I was told was the minimum I was able to see them based on the hours I currently worked. Needless to say this was never adhered to because he also said he would never keep me from seing the children. We live in a small place just 2 miles from each other. When he decided to make me adhere to the minimum from 2years earlier I filed.
    Pro se a modification of timesharing petition. At our first and only mediation his attorney informed me that if I quit he would not come after me gor back and continuing child support. I have since retained an attorney but am curious for any other input on this matter. Son is now 8 and wants it back like it was. Being anle to see his mother daily. And my ex has never accused abuse or implied that I am or ever was a bad parent. However this all started shortly after his now wife then girlfriend had moved in with het 3 children all from different fathets. Any advice out there?

    Advice about what? What's your question?

    If you are asking whether your ex- is entitled to seek support, despite any past agreements, yes, he is.

    Agree. He's only obligated to provide visitation as outlined in the divorce decree or in any future court order or modification. Twice during the week and an overnight is about standard. He also has the right to request child support. If the child is now 8 and you've had frequent visitation (ie the ex has known where you were all along), it's probably wishful thinking on his part about collecting past child support in FL, but once he gets the court to award him child support, it would absolutely be retroactive to the date of his filing for support (so not long, maybe a couple of months). The girlfriend situation isn't relevent.
