    Default Emancipation in Tennessee

    My question involves emancipation in tn

    Im 16 years old and have been fighting my mom in court for 9 months over a custody case with my ex step father. The court is leaning towards her side because he has no legal gaurdianship over me. I choose to live with my him over my mom due to the fact that she is a chronic lier and a drug addict. She steals the money i get from my death benefits from my father that died two years ago. She has stolen 13,500 dollars of my money on her drug addictions. I have a job and am able to support myself with the possiblity of renting a room with my cousin who is 27. She will not sign on my permit or drivers license ue to the fact that i choose not to live with her ad her drug addicted boyfriend.


    She has taken my sister from me and moved 50 miles away and is attempting to turn my sister against me. I am completly at a lose and need to know if i apply for emancipation of if the court will grant me it due to the fact there is no emancipation law in tennessee. I am currently a sophmore in my school making good grades and on the road to graduating. I have a job that gives me enough to pay rent, pay half on bills, and provide the basic necessitys of life. i just need to know what path i should take or should i even consider emancipation.

    Nope.

    I am currently a sophmore in my school making good grades and on the road to graduating. I have a job that gives me enough to pay rent, pay half on bills, and provide the basic necessitys of life.
    Even if emancipation were available to you - and in your state, it is not - you still wouldn't qualify. You would need to be able to show that you are capable of paying 100% of everything - 100% market rate rent, 100% utilities, food, clothing, school necessities, medical care, incidentals, all by yourself, without any help from anyone. Further, you would need to already be living on your own for a period of time, usually a year, to demonstrate that not only do you have the financial means to take care of yourself, but you have the sense enough to do it properly.

    I can honestly say I am speechless that mom provided absolutely nothing to your support for 16 years and then had the audacity to take any money for your care.

    There IS no such thing as emancipation in your state. And if it did, you wouldn't qualify. Just forget about emancipation. It's not going to happen.

    The only way you are going to be able to move out without your mother's express permission is if the state removes you and puts you in foster care.

    You don't have other options at this moment. If you are living back with mom and see crimes being committed, you are free to call the police and report them. If you are being abused you are free to call and report it. You might mention to mom your intent to do so, prior to going to court.

    Did you not read what I wrote? Emancipation is not available in your state. Or, in shorter form, No Emancipation For You.

    is there any other way to seperate myself from my mother who has mentally abused me for the past 6 years of my life?
    If you're being abused, you call CPS. Elsewise, your option is to turn 18.

    if the court takes me from my mother would they or could they even put me with my ex step father?

    The ex-stepfather is not likely to be a stop on the CPS train because he is legally no one to you. They will try to place you with another family member but there are no guarantees. Could he be an option if all other options are exhausted? Don't know.

    Default Child Left With Stepparent By Neglectful Mother

    My question involves child abuse or neglect in the State of: Tennessee


    I am 16 years old and have a pending court case with my ex step father battling against my mother for custody. My mother is a drug addicted chronic lier and has mentally abused me for the past 6 years of my life. My mother dropped me off 50 miles away from where she lived and told me she didnt want me anymore that was 7 months ago. I called my ex step father to come pick me up and have been living with him since. She tells the court that she is scared for me to be around him due to lies she has made up in courts and police reports, but she still chooses to let me live with him telling other police officers and judges that i am safe and taken care of where i am at. She refuses to give me an insurance card so i can go get the help that i need for my anxiety and mental problems that she has caused. Is this proof enough to the courts that she is not stable? She has no home and is living with her boyfriend his daughter my sister (who chose to stay with her) his daughter and his parents in a four bedroom house. I need an outlook on people who are un-bias to my situation and anything that i could do to help us win our court case....
