    Default Possession of Stolen Bicycle

    My question involves criminal law for the state of: CA

    I got a ticket for a possession of a stolen bicycle valued at about 280$ (2010 Diamondback,original cost then: 450$). I attempted to sell it on craigslist, scheduled a meeting with an undercover cop, he wrote me the ticket, released me later that day, avoiding putting me in jail; he said he could have. My court date is the middle of March 2012. This is my 1st offense for possession of stolen property in my life. I'm 41 years of age. I have a DUI from about 15 years ago on my record and that's about it for my record. What can I expect from this?

    Personally I am more than willing to just do the jail time because I don't want to have to do any programs or pay any money, which I won't. I'm homeless, unemployed and have no income.

    Really appreciate any insight into this...

    If it matters: when I got the bike, it was in terrible, abused cond., rusted, etc. I fixed it back up, tuned it, to the point of almost a new bike and I'm assuming the bike was returned to the owner (since the serial# was a campus bike near where the cop works) probably making the owner of the bike quite happy to get it back in new condition a week later after he/she lost it.

    If the facts you present are true, one wonders how you had the money to clean and fix the bike, advertise it and sell it, as well as regularly make internet posts.

    Given that you didn't tell us anything helpful here, other than all-but-confessing to stealing the bicycle, we couldn't really tell you much beyond suggesting that you consult a lawyer with the facts.
