    Default Can I Get in Trouble for a Roommate's Actions

    My question involves criminal law for the state of: California.

    If I was on formal probation and had a roommate that was growing a small amount of medical marijuana in his room (with a locked door). Would I be at risk of facing a violation if they came and searched the place?

    Side note:
    I have 14 months clean and am no longer involved with any sort of illegal activity. I am just renting a room and can't break my lease so I just need to know if it's worth spending the couple grand to get out ASAP. I also have not been in trouble with the law for almost 15 months and went through a 1 year intensive treatment center. I have recently been transferred to one of Southern California's largest cities probation from a small counties so I don't even know how intensive my probation still is. But I would like to know for my own peace of mind if I am in any sort of legal conflict.

    My roommate is completely in compliance with Prop 215/SB420. His room is always locked and I have no access to it.

    Yes you can get in trouble. The fact that you knowingly and willingly recise in a residence that is promoting illegal behavior/acts can result in a violation, regardless of any additional criminal charges.

    Should I look to move out? It's just an awkward situation because I don't really know the guy and he didn't tell me till after I had signed the lease. Although I didn't mention I was on probation till after we signed (because I feel like people on probation get a bad rap, even though we are not all bad people.) My lease is up in April so is it correct to think that I should start looking for a new place? I also was under the impression that since Medical Marijuana is protected under state law. I am just trying to get information because I have been doing so well and am looking to continue to stay out of trouble.

    Those activities are valid grounds for breaking a lease.
