My question involves paternity law for the State of: New Hampshire and Virginia I believe that I am the biological father of my 7 yr old daughter, mother told me I was dad and has allowed me visitation on weekends for the last five years. I have a wonderful bond with my child however she was born into a marriage and assumes a different last name. Legal dad is in the navy and lives in Virginia, child was in New Hampshire. He apparently knows the child isnt his but still has paid child support to my daughters mom which was court ordered in 2008. Apparently she has been lying to us both for years, telling him hes dad and me I am dad. While I have taken physical, emotional, and financial responsibility she has continued to collect off her ex. Recently she received a six month jail sentence for 4th offense of driving with a suspended license. For two weeks after being locked up my child was with me full time and I was bringing her to school etc... About a week ago I had a knock on the door and it was the ex husband looking for my daughter. Long story short, he took her and brought her to Virginia. I don't have a legal leg to stand on as a DNA test was never done. This man has only seen her maybe twice, she knows only me as dad. How do I go about getting a paternity test done with mom in jail and legal dad not returning calls or wanting to resolve the issue. I have contacted lawyers here and they want me to get the test done first so I can bring her back to New Hampshire and fight for legal custody. Can I have a court in Virginia order the test? Do I need to seek representation there? Help
