    Default Non Legal Name Change for Passport

    My question involves name change laws in the State of: California

    I was born in wedlock with the last name Johnson, that was given on my birth certificate. When I started school my mother registered me with the last name Larsen. A few years later she married my step father. They went to the Social Security Department and got me a new social security card with the last name Smith. I now have two SSC, one with the last name Johnson and one with the last name Smith, both have the same number. When I started my new school my mother registered me as Smith. I got my license in Smith as well. I have been going by Smith now for the past 22 years. Four years ago I applied for a Passport but was denied because my documents did not show the same names and I did not have any legal name change documents (it was never done legally). I am now 27 and again trying to apply for a passport. I have gone to the DMV and changed the name on my license to say Johnson. Today I recieved a letter from the Passport Agency saying that the information provided was not sufficient enough to approve my passport. They are asking for a ton of information and even want five documents showing my name (Johnson) that are five years old or older. But since I have always gone by Smith I do not have the documents. I need some suggestions on what to do. We leave on vacation in May and I need this taken care of ASAP....

    Why not simply do a legal name change? It's by far the easiest way to accomplish your goal.

    My legal name is Johnson, so I changed all documents to show that name. But because I have never gone by that name it is giving red flags. Are you suggesting I legally change my name to Smith?

    If all your docs except your BC and recently changed DL say Smith, then yes a legal name change to Smith would be the easiest way to get everything in order to get a passport. You, and your mother, have mucked up your identity to the point that getting the Courts to declare you one or the other is quickest.
