    Default Prima Facie MPH vs Posted Speed Limit

    My question involves a traffic ticket from the state of: CA. Hello, at 8am this morning I got a speeding ticket for going 50 in a 35 mph zone. The officer wrote in the P/F Max speed box: 30. I was in the rt-most lane (of 3 lanes) and was merging to the left. Traffic was light at the time and the posted speed limit was 35 mph. Can I fight this??? Will I be fined for 20 mph over the limit?

    And if I can fight this, should I try the trial by written declaration? Thanks for any help with this.

    The ticket will be issued for 20 over. 30 vs. 35 is immaterial to your defense, but you should show it anyway (take photos, etc. and get the survey), since it will reduce the fine by a decent amount.

    Get the survey and post it here. Then we can give you a better estimate of your chances at winning. You should go with a TBD then.

    But that extra 5mph over the limit is an extra hundred bucks. Making me think they want to just increase their revenue made for the day.

    contact your state reps and ask them to lower these outrageous fines in your state
