150 Grams of Marijuana; Possible Intent of Sale

My question involves criminal law for the state of: Minnesota

So I was pulled over one night at a stop sign. He told me that I was pulled over on behalf of a license plate light that was out in the back. He asked for my license and registration, and I told him that I did not have my license on me and showed him my insurance. On leaning closer he said he could smell marijuana and told me to get out of my car. I refused countless times as he kept asking and went to his car.

He came back and after a few more times of me saying no a second officer came and opened the car and held a tazer to my face and told me to get out. At that point I did and they started to search me. They went through my pockets and pulled out every item. They found a large sum of cash and a retractable switchblade. In the car they found a second phone in the car (with lots of drug distributing information ), along with a marijuana pipe and 150 grams of marijuana. The marijuana was separated into two baggies, of random denominations.

I made no official statements, but when I met with the narcotics officer, he told me that he had gone through my phone and was well aware of how much I was picking up and how much I was able to distribute. He gave me pretty good details on how much and how many people. At that point I talked with him about what I could do, and gave him random false names and locations and told him I could do that for him. After I was released from jail, a few weeks later I went back to my PD and retrieved both of my phones.

He has called me since then and asked if I still wanted to work with him, and if not I would have a month or so until the charges were sent. My question is if there is anything in the story that could be either helpful or detrimental to my case. No official statements were made, but they are pretty well informed that I am a distributor . This is my first offense for anything other than a speeding ticket. I attend college at a well known university, but don't have anything else under my sleeve. What do you think are my chances of being able to get expunged or being let go for a first offense? If at all ?

I think your chances of expungement and/or deferral for a 1st offense are about zero. The cop had valid reason to stop you, had good probable cause for the arrest, and conducted a legal search. You were found in possession of over 3 times the weight needed for a felony possession charge...even without the ironclad evidence for distribution. This is a slam-dunk case.

I have no doubt that the detective has already confirmed that you were lying to him (even if he didn't know you were lying as the words were coming out of your mouth). But, it sounds like he already got enough info off your phone to open investigations on both your suppliers and customers. Your best bet is to contact the detective sooner, rather than later. Get on a written contract with him and the prosecutor as an informant in exchange for no charges filed. Then give them everything they want...information, controlled buys, the whole works. But, if you lie to him again, even once, even about something you think is "no big deal," you will void the contract and they will charge you so fast your head will spin.

I only see that you have 2 options...snitch or go to prison. You've been smoking too much of your own product if you think this has any chance of being expunged or dismissed as a first offense.
