    Default Reckless Driving Violation In New Jersey

    HELP ME PLEASE!!!

    I am not NJ resident.
    I have WA Driver's License for 5 years, with clear driving records.... until few hours ago.
    I rented a car in NY and drove to PA with 2 of my friends. I drove the car.

    While driving back to NY, it was rainy at 9pm, we were in NJ at I-78 heading east. At the time I was driving at the left lane, there was no car driving at left lane (all were in the middle and right lane) so I speeded up.

    I was stopped by a NJ state police & he gave me 3 tickets:
    1. Speeding 108 mph in 65 mph zone.
    2. Failure to signal.
    3. Reckless Driving.

    I was told to attend to the court in NJ on a given date. At that date I would have been returning to WA.
    This is my 1st ticket. And I never commit any crime nor involve in any unlawful activity.

    I did not mention to police or my friends the reason why I drove fast because it is embarassing: I was trying to find a restroom. But now I regret that so much after knowing this can jeopardize my driving privileges and face possibility jailtime.

    QUESTIONS:
    1. What will happen if I do not show up at the court in NJ? Will something happen to me (like be arrested?) or to my WA driver license?
    2. What will happen if I go to court? I'm worried that my driver's license will be suspended or I may go to jail?
    3. Is there any way to get away with this problem?

    1.) Failure to appear in court could result in a warrant for your arrest and your driving privileges in New Jersey revoked and additional fines. (You don't want to do this, you need to take care of it.)

    2.) This is what could happen for the reckless:
    39:4-96. Reckless driving; punishment

    39:4-96. A person who drives a vehicle heedlessly, in willful or wanton disregard of the rights or safety of others, in a manner so as to endanger, or be likely to endanger, a person or property, shall be guilty of reckless driving and be punished by imprisonment in the county or municipal jail for a period of not more than 60 days, or by a fine of not less than $50.00 or more than $200.00, or both.

    On a second or subsequent conviction he shall be punished by imprisonment for not more than three months, or by a fine of not less than $100 or more than $500, or both.
    You should get an attorney to help you with these violations. Hopefully you will be able to get the reckless reduced to careless and maybe get the others dropped.

    Two of your tickets (reckless and speeding over 30mph) are 5 point violations, so you really need to try and get these reduced and a lawyer that specializes in this is your best bet.

    Do you mean warrant for arrest in NJ only, or also in WA? The warrant would be issued in NJ, but if you were pulled over in WA, they very well could be made aware of the warrant.

    Revocation of driving privileges in NJ only, or also in WA? Washington is a member of the "The Drivers License Compact".

    About the Non-Resident Violator Compact
    The Non-Resident Violator Compact requires member states to suspend the drivers license of those who get traffic tickets for moving violations in other states and fail to pay them. The compact is not supposed to include non-moving violations such as expired inspection stickers, equipment violations such as window tinting or parking violations. A member state may choose to voluntarily suspend a license of a person who does not pay an out-of-state ticket for an equipment violation such as loud exhaust.

    If you can get these reduced, it would save you money in the long run, i.e. increased insurance premiums, fines....

    OK, I have decided to get an attorney to help my case. Right now I am searching.

    I have some concerns:
    - I see reckless driving is regarded as gross misdemeanor in both WA and NJ.
    How to have reckless driving charge eliminated?
    If the court decides to charge me reckless driving, but give reduced points, is that still considered misdemeanor?
    If I am convicted for reckless driving, but not facing jail, only pay fines, will this be recorded in my criminal record? If yes, can it be eliminated from my criminal record?

    - Some attorney I talked to today said they probably could have reckless driving charge changed to careless driving.
    Is careless driving a misdemeanor in either state?
    Will this be recorded in my criminal record? If yes, can it be eliminated from my criminal record?

    - If the judge in NJ suspended my driving priviliges in NJ for certain time, will WA take some action following that suspension in NJ (i.e. suspending my driving license)?

    Thanks in advance for the answers.
