    Default Can a 1970 California Child Support Order Still Be Collected Upon

    My question involves child support in the State of: California

    My father paid almost none of his ordered child support payments to my mother. He spent many of the years unemployed. Now a LOT of time has passed, and he has received an inheritance when his mother died.

    Is there a time limit on collecting support?

    If so, can adult children go after back support, or does the custodial parent whom the payments were due have to initiate collection?

    Child support is never owed to the child.

    The CP would have to initiate collections. Luckily for the CP, in California there is no SOL on collecting, and the "equitable doctrine of laches" CANNOT be used as a defense when it comes to child support.

    ("Laches" is basically a defense wherein the debtor states that the creditor has waited too long to fairly collect on the debt)
