    Exclamation Evading Arrest in a Vehicle

    My question involves criminal law for the state of: Texas
    I was arrested for evading arrest but that was the only reason. They didn't have a reason to pull me over. Someone told me to ask about unlawful arrest. They didn't explain much so I thought I'd ask here. If you need more details please ask.

    The problem is, you don't know the initial reason for the stop. It could have been numerous things that caught the attention of the police. By fleeing, you opened up a new can of worms. Unlawful arrest would be them arresting you knowing all along that the arrest was invalid. If you ran from the police and you are questioning if the arrest was illegal because you don't believe that they had cause to stop you in the first place, you're mislead.

    They do not have to charge you with the underlying offense. When your attorney gets a copy of the police report, I suspect it will include the reason they attempted to make the original stop.

    Or, are you arguing that the officer was merely cruising along and randomly decided it might be fun to commit a federal criminal offense and randomly stop some dude riding along and minding his own business?

    Ok thanx I have another question I might be going to a school out of state, if get put on probation I know I can transfer it but do you think that state will accept me because I'll be going to school?

    If you can provide your acceptace letter and residence approval, you should have little issue.
